EVOLUTICA LLC ("we", "our", or "the Company"), with its legal address at 1414 W CHILTON AVE, GILBERT, AZ 85233, USA, is committed to protecting the privacy of its users and clients. As a Technology Provider and developer of AI and eCommerce solutions, this policy describes how we collect, use, and protect information in accordance with the policies of third-party platforms, specifically those of Meta Platforms, Inc.

2. Information We Collect

We collect the information necessary to provide our technological services, including:

- User-provided data: Name, email address, company name, and contact details.

- Integration data (APIs): When you use our tools integrated with Meta (Facebook, Instagram, WhatsApp), we may access authorized data through the permissions requested in our applications.

3. Use of Data and Meta Permissions (API Usage)

As a Technology Provider, EVOLUTICA LLC uses Meta APIs to offer advanced features. We declare the following:

- Marketing and Ads Permissions: If we request access to ads_management, it is exclusively to allow the management, creation, and optimization of advertising campaigns within our platform for the benefit of the client.

- WhatsApp Messaging: Access to whatsapp_business_messaging and whatsapp_business_management is used solely to manage communication with clients and administer WhatsApp Business accounts (WABAs) under the Technology Provider model.

- Transparency: We do not use data obtained through Meta APIs for purposes other than those specified in our application's functionality. We do not sell or share Meta user data with third parties for outside advertising purposes.

4. Our Applications and Products

EVOLUTICA LLC operates under the commercial brand "Evolutify" and develops multiple software products and applications. This Privacy Policy governs the data practices of EVOLUTICA LLC and all products listed below, as well as any future products or applications developed by EVOLUTICA LLC under the Evolutify brand or any other trade name.

4.1 GENIA

GENIA is an AI-powered conversational agent platform, developed and operated by EVOLUTICA LLC under the Evolutify brand, that enables business clients to automate customer communication via WhatsApp Business Platform. GENIA operates as a multi-tenant SaaS solution: each business client (organization) is provisioned with a dedicated WhatsApp Business number, an AI agent, and an administrative dashboard.

Data collected by GENIA through the WhatsApp Business Platform includes:

- WhatsApp phone numbers of end users (customers of our business clients) who message a business client's WhatsApp number.

- Message content, including text, and metadata such as timestamps and message identifiers, exchanged between end users and the business client's WhatsApp number.

- Media files (images, audio, documents) sent by end users through WhatsApp, when applicable to the conversation.

- WhatsApp Business Account (WABA) identifiers, phone number identifiers, and business profile information of our organizational clients.

- Public profile information (public_profile permission) used to authenticate and personalize the experience of users accessing the GENIA dashboard.

Purpose of processing: This data is used exclusively to (a) enable the AI agent to receive, process, and respond to messages on behalf of our business clients, (b) allow human agents employed by our business clients to review and take control of conversations through the GENIA dashboard (Human-in-the-Loop functionality), and (c) provide conversation analytics to our business clients regarding their own customer communications.

Permissions used: whatsapp_business_messaging, whatsapp_business_management, public_profile.

GENIA does not sell end-user data, does not use message content for advertising purposes, and does not share end-user data with any party other than the business client who owns the corresponding WhatsApp Business Account and the data processors listed in Section 6 of this Policy.

4.2 Future Products

As EVOLUTICA LLC develops additional applications or products under the Evolutify brand or any other trade name, this Privacy Policy will be updated to include a corresponding subsection describing the specific data practices of each new product, following the same structure as Section 4.1. Users may always refer to this Policy, at this same URL, as the single authoritative source of our data practices across all products.

5. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this Policy:

- Message content and conversation data processed by GENIA are retained for the duration of the active business relationship between EVOLUTICA LLC and the organizational client, and for up to 12 months afterward for support and audit purposes, unless a longer period is required by applicable law or requested by the business client.

- Data obtained through Meta APIs is retained only as long as necessary for the purposes disclosed in this Policy and in accordance with Meta's Platform Terms and Developer Policies.

- Users may request earlier deletion of their data at any time, as described in Section 8 below.

6. Data Processors

To operate our services, including GENIA, EVOLUTICA LLC works with the following data processors, all of which are contractually bound to process data solely on our behalf and in accordance with this Policy:

- Vercel Inc. — application hosting infrastructure (United States)

- Supabase Inc. — database and backend infrastructure (United States)

- Cloudflare Inc. — network, security, and DNS infrastructure (United States)

- OpenRouter — AI language model processing infrastructure (United States)

We do not share personal data with any processor, service provider, or third party other than those listed above, except where required by law.

7. Data Storage and Security

We implement industry-standard technical and organizational security measures to protect data against unauthorized access. Data obtained through Meta APIs is handled in strict compliance with Meta's Platform Terms and Meta's Developer Policies.

8. User Rights and Data Deletion

Users have the right to access, rectify, or request the deletion of their personal data. To request the deletion of data associated with our Meta integrations, the user can contact us at hello@evolutica.co. We will process these requests within a maximum period of 30 days.
